As in-house counsel to a company of 100 employees with offices in four cities and three countries, part of my job is outside counsel cost management.
I constantly question if I have the right outside lawyer doing the right job for our company. With only one significant litigation arising every three or four years, the question of whether to use a big litigation defense firm or a boutique defense litigator is very important to us – because litigation fees can easily run in excess of six digits.

While I can handle talking to a different paralegal every time I call an outside firm about a trademark application, it is vastly different when the core of the company is exposed to a multi-million dollar petition. We do not want a massive team responding to our case, all with less than complete knowledge of the case.
Rather, when the big chips are on the line, we want to know that the lawyer handling our case has been with the case from our first Answer and Counterclaim through to the Texas Supreme Court.
Our experience with Jack was nothing short of miraculous. As defendant, we were in litigation against a 175,000 employee corporation plaintiff seeking $3.1 million in damages.
After four years, we were awarded at trial our attorney fees and small compensation in support of our fraud counterclaim, while the plaintiff was awarded less than $10,000 on his claims against us. Naturally, we had long ago offered significantly more than $10,000 to the plaintiff in an attempt to shut down the legal fees!
We are now awaiting the decision from the Texas Court of Appeals regarding the Plaintiff’s appeal of our attorney fee award.
When it comes to litigation, the lawyer arguing the case at trial should be the lawyer who answered the first petition. Otherwise, knowledge will be lost in an inefficient manner. In our case Jack handled the first petition, all discovery, trial, the appeal, and Jack will be there to argue our case before the Texas Supreme Court, if required.

We had the opportunity to use the legal services of Jack Kuykendall for a Department of Labor, Wage and Hour Investigation of our company. We are a wholesale plastic distribution company and have been in business for 30 plus years.
We employ approx 75 employees in the state of Texas. After contacting Jack that we were being investigated by the Department of Labor, he immediately stepped in and communicated with the investigator and made clear to us what was needed and how to expedite the handling of this entire procedure.

I practiced law for more than 40 years, the last 11 as a counsel for Dallas Area Rapid Transit (DART), before retiring as DART's deputy general counsel. It has always intrigued me to see whom a great photographer chooses to shoot the pictures for his own wedding, or which specialist the doctor chooses for her own surgery.
